Title: The piratebay owners found guilty
Post by: evilfantasy on April 17, 2009, 09:22:35 AM
Well I can't say I'm happy or sad about this. Part of me thought they might actually have a compelling case but when I saw the images a while back of them setting there in court looking like they were on spring break out for lunch I sort of figured they didn't have much of a chance. It's one thing to operate a web site that is in a gray area but to go into court to defend yourself with an obvious "I don't really care" attitude then you get what you have coming.

To everyone who has an attitude about downloading illegal content and tries to justify it then we now have a legal case bigger than any other to point to.

Quote
"The Stockholm district court has today convicted the four people charged with promoting other people's infringement of copyright laws," the court said in a statement.

The four defendants in the case, Fredrik Neij, Gottfrid Svartholm Warg, Peter Sunde and Carl Lundström, were each sentenced to one year in prison and ordered to pay 30 million kronor ($3.56 million) in damages.

what a stark contrast to their posts claiming "YOU'LL NEVER CATCH US. STOP TRYING".

ha ha ha. Guess they were wrong.

But- why does it say, on the site, "Epic win"? That doesn't make sense... Unless it's some metaphorical pithy form of winning that involves losing first... but I'm probably breathing far more literative essay into it then it deserves.

I can see, the site is still up: http://thepiratebay.org/

It's called arrogance. The same arrogance they displayed in court and it cost them one year in prison and 30 million kronor ($3.56 million) in damages.

But as in all good movies, the heroes lose in the beginning but have an epic victory in the end anyhow. That's the only thing hollywood ever taught us.

They think they are superheros... ::)

I'm simply curious why the site is up.

I'm not a layer but I "think" that as long as the case in in appeals then their assets, website included, will still be in the control of the owners and not the court or lawyers or whoever.

I don't see why people need to keep taking thepiratebay to court.  It is only a website!  I mean, it may have illegal movies, operating systems, ect, but isn't that what their site is know for?

So I guess that same logic can apply to certain forbidden types of pornographic imagery?

"I don't know why they keep taking child porn sites to court, it is only a website! I mean it may have illegal images but isn't that what the site is for?"

It's also a similar reason they still charge people with murder for killing a person with a gun. I'm sure you find that a bit ridiculous since you know- "handguns are made for killing- they ain't no good for nothing else." <---(can anybody place this quote ;D)?

What you said was basically, if something was designed for something,  that "something" cannot be illegal, regardless of what it is.

well, if let's say piratebay gets shut down so their site was not accessible anymore, then people could just hop onto mininova or isohunt and make it a new piratebay so whatever....

one site down, new site replaces it. never ending cycle of the law enforcement trying to close down unclosable loops.

Gee, for a site that doesn't encourage piracy, there sure are a lot of people here that flaunt it

I'm no exception, however, so don't go flaming me!  (|

Being aware that it exists and discussing it is far far different than actually participating in it.....

Yep, admitting and supporting are two different things ;)

And will be as long as it is in appeals. They have not officially lost or won their case yet.

Not only that they have just discovered the Judge on the case has ties to copyright firms which could result in the case being overturned or thrown out altogether....

Will they closed the site?
Title: Re: Thepiratebay owners found guilty

Possibly, eventually.

I doubt the owners would let it stop though, they'd start up somewhere else.

But my two cents....This is going to cause so much publicity for TPB...that the amount of filesharers will boom. They start using TPB, they learn what a torrent is, how to use it, and where to find more, and they spread...

If that happens then they should throw out all cases where a judge has ties to lobbyists. Wouldn't be any criminal cases left then...

Which is a good approach...

Although I imagine there has to be a line drawn somewhere-  maybe one day they'll throw out cases because the judges ex-wifes pet dog was previously owned by a boy whose mother once worked in a restaurant where a regular customer whose truck driving career brought him close to the home city of the defendant's 2nd-cousin twiced removed's Granfather's  best friend.

Actually, I'm from Wichita, which is a fair-sized city. We don't get many people there like that, but I have been to places in Kansas and all over the Mid-West like that.  ;D
