only by definition. 1/4th of most lawsuits that go to court in North America are frivolous or fraudulent; thing is, anybody can file a lawsuit for
anything at all; I could sue burger king for making their employees wear hats, or for wearing mops, or because I saw a dog outside their store that barked at me and the bark seemed to call me a derogatory name- it is up to a judge to decide wether the case goes to a court.
In this case, it isn't so much a "frivolous" lawsuit as much as it is a pointless one; spammers gonna spam- but, if they get hit with a hefty fine or have to settle outside of court for a hefty price they might tone back their aggressiveness.
Seems more like frivolous lawsuits to me. Who's to say you can't simply get a spam filter?
that's no different an argument then saying that a lawsuit against somebody for car theft is frivolous because the car should have been better secured. It's not the computer owners responsibility to make sure that everybody sending them mail is following applicable harrassment and spam prevention laws.
Concentrate on this: The more time and money (your money, if you live in the US of course) that is being used on court cases like these, the less time and money that will be available for serious cases involving abuse, theft or murder.
Concentrate on this: if you don't like seeing court cases like these, lobby the government to repeal any and all privacy and harassment laws so that the aggressive spammers are no longer breaking any laws.
