Unable to delete

I downloaded a path for a game, but the download crashed and so on my desktop was a icon with the patch name.  When i try to delete it, an error message pops up stating that another person or  programe istrying to use this one.  Do you have any suggestions for what i should do, to try and delete this?

I've tried to download killbox, but the zip file opens up in windows media player.  *censored* do i do to stop it from doing that and make it open up in a way that i can use it?

    Right click the file & select the 'open with' option then choose winzip.

    If I was you I'd be seeing red flags waving, have you scanned your computer?
    Did you get the patch from a reliable source?
